"Lost" Account

What is the name of your state? Connecticut

My wife was an employee of a company (coincidentally a large brokerage) and joined their 401k plan. She since was terminated when the company merged with another, but still has funds in the 401k.

That said, the company recently outsourced the management of the 401k to another financial institution. In the process, her account was "lost". The new manager has no record of her, and the only contact at her previous employer is an HR rep who is "still looking for it".

Are there any IRS or SEC regs that we can quote to get some real action from the company to find our funds, or should we get an attorney immediately?

Your wife has some records and she should make sure the company has copies to help the search -- and keep the pressure on the company to find it.

That said, if you have a lawyer friend, ask the lawyer to write a letter for you -- that will usually speed up the search, but DO NOT PAY a percentage of the funds to the lawyer!
