Hello, I've been working with a documentation preparation specialist who has been taking care of preparing and handling my divorce. I've been separated, living in a different state from my ex husband for over 5 yrs. I left the marriage due to domestic violence and affairs he had. I've finally decided to get divorced to move on with my life, the specialist forwarded the documents to the sheriff in my ex husband state on January 9th. But my husband is dodging being served, and it's March now. What can I do?

If you had an attorney, I would be recommending that you talk to your attorney about getting permission to serve him via publication. The other option would be to hire a private process server. Is there any particular reason why, after 5 years, that your husband wouldn't want a divorce? Does he know that its a divorce that the sheriff is trying to serve him with or does he perhaps think that its something else?

I'm not sure why he doesn't want a divorce. I said I didn't want any of his money or anything so he didn't have to worry about me taking anything. But he has always just tried to make me miserable I don't know why. I forgave him for all he put me through and didn't think he'd deny me my divorce. Part of me thinks he's doing it to halt me getting married again. He very much knows he's being served divorce papers. I really don't want anything at all from him but a divorce I just want to live a happy life and move on from that part of my life

Look up "constructive service of process Florida divorce".

There are several steps you have to take to satisfy the court that you have made a reasonable attempt at having him personally served.

He likely does not want a divorce because he is a controlling person.

I really think an attorney could help you navigate this in an expeditious manner. What you need is permission to serve him via publication since he is dodging service.
