What is the name of your state? Florida My daughter's father has been "missing" for around 4 months now and over a year he has been volunteering support rather than having it garnished out of his wages as stated in the support order. He has arrears totalling a little over $5,000 are we (my daughter and I) entitled to all of it at once? and am I allowd to sue him personally for mental stress since this has put me in such a financial strain and I have gone with out my personal things to make up for all of this?? :mad:

What do you mean he's "missing?" Is he sending the support payments through CSE?
Mental stress? You've got to be kidding me! No you can't sue. We as CP shouldn't depend so much on CS. We need to be able to make it on our own in case things like this happens.

Also, chances are you won't see any lump sum payment. He will have to pay you in installments. Just like anyone else gets arrears money. It could be $5 per month or it could be $100 per month but that's up to a judge.
