in the state of ny on december 17,2000 i mailed a package through a local shipping service, this package was sent from ny to miss. the package was never delivered to the correct address, it was left at a wrong address, as no one was home to leave the package with, they left it inside the door of someones home. i have placed several call with the shipping company and had a tracer put on the package, the shipping company now went to the correct address and inquired about a delivery and was told they never received a package from me, (my return address was on the package), so now this shipping company would like to pay me for the insurnace of this package, i have asked them to try another avenue to find this package and i was told that to much time has lapsed and the driver has no memory as to which house he left the package at, i really want my package back, do i have a legal right to pursue this matter

Since the mistake was due to the shipping company's negligence, they are liable to you for your loss. If the amount of the loss is limited or defined by the insurance contract. the terms of the insurance prevail.

They probably do have a duty to pursue reasonable means to find the package. What is reasonable depends on all the circumstances. If they feel that too much time has passed, that may be a reasonable reason not to search for the package. Although the answer is not totally clear in this, my feeling is that insurance reimbursement is all you can expect in this.

You could find out the numbers of the people who live near to the addressee of the package and ask them if they remember receiving the package.
