lost money in atm

I deposited alot of cash in a td bank atm here in montreal..and the bank didnt find it.
now in waiting for small claims court to order my money back...what do you think my chances are to get my money back...the only proof is the atm stub and the gic certificate that i was buying with the money,bank book of the widthdrawn money.

If the bank was regulated by FDIC and/or other US governmental entity, there may be recourse.
I never deposit cash in ATM especially if machine in Canada.
