I lost a paycheck (my severance pay)and found it one week AFTER the 90 days before it was void. If my former employer or their bank refuses to honor it now, what legal recourse will I have especially since I'm going to pay taxes on it at the end of the year anyway?

You have no legal recourse. Whether or not you will be paying taxes on that last paycheck. The only required act of the employer was to pay you. They did that. It is not up to them to make sure you cash that check. Nor do they have to re-issue you a check because you didn't cash it prior to its expiration.
