on april 14, 2000 my son paid for a rebuilt transmission at a nationally owned shop. in january 2000 this transmission blew up and he can not find the receipt, which is the warranty. when i talked to the owner he stated that he did not own the shop at that time and he can not find any purchase orders. i contacted the national office and they also could not find the purchase order. i have received the canceled check from my bank which shows a number on the memo line which i did not write. when i showed this check to the owner he stated that it was a fake number and that the previous owner probably pocketed the money and never sent paperwork to the national office. i have again contacted the national office but am not to hopeful. do we have a case for small claims court?

You might have a valid claim in small claims court. If the new owner of the business merely purchased physical assets, then he may not be liable for the obligations of the old business; however, if the business is a corporation or some other entity and the new owner purchased the business itself, then the business (or the new owner) is liable for the obligations of the old business.
