This is my poblem i just got engaged to my fianca who lives in Calfornia. I have a 2 year old daughter to a different man. He has had nothing to do with her untail this past Christmas because he found out about my fiance. I was gettting ready to move to California with him and now my ex has stopped me. Everybody I turn to for help tells me about fathers rights. There is and order in for childsupport but he rarley pays untail they tell him he is going to go to jail. He sees her one weekend a month or every other month his choice. My fiance would move here but at his job he gets paid 20.00 an hour he has his own house and i have just lost my job and my car has just broken down. I dont see how we would be better off living here rather then there. I have agreed to fly my daughter here every summer to spend with him and pay for the cost all he has to do is meet me half way. Do I have a chance?? Dose it all depend on what my ex says in the end??

It all depends on which of you present a better case to the judge as to what's in the kid's best interests.

And don't forget to compare the cost of living in both places. Housing costs in parts of CA are astonomical, compared to other places, so one can live as well on less in other places. My hubby could make a lot more in NYC, BUT it would costs us a lot more to live there than it does where we are now- so it's a wash.

AS stated, a MOVE by the child would be up to a judge.

I'll probably get "bashed" from others by saying this, but you could go ahead and move with your finance for a considered "better life" for you and your child, and hope your ex just doesn't fight it any. If he does, point out that he doesn't pay CS or visit the child regularly and your new life with your husband provides much more stability for your child. Plus the fact that you are so willing to agree to liberal visitations AND pay 1/2 the transportation costs is in your favor. You would not be keeping the child from her father.
