What is the name of your state (only U.S. law)? NY

In the state of NY, if on probation for DWI, and you win the lottery am I able to keep the money. Im asking bc is technically considered gambling.

And no I didnt win the lottery lol I wish

the law deals in technicalities.

If you are on probation, for whatever reason, including DWI, don't gamble including lotto.

Not only do you risk forfeiture in the event of a win (extremely remote) but even if you lose if discovered you would get violated and suffer serious consequences.

The prohibition on gambling does not mean illegal gambling, or exclude state sponsored games.

That stupid, I cant even play the lotto? Are you sure about this? You were saying if i do win the chance of me having to give the money over is extremely rare?

I believe IF you play any legal NY State Lottery games and/or won , it would not violate your probation , because it is legal .

I believe what the poster meant was depending on your charges and and the crime , some include forfeitures of properties.

In all seriousness ,ask your PO.

Could be in for a chuckle .

A fellow around these parts won 7 million . He was on probation for DWI's.

Now get this. He bought a new Home ,cars,boats ,whatever.

What does he do ? Purchase large amounts of Pot ,then Drives Drunk AGAIN and gets busted for both .

Guess where his house and toys went ?

Guess where he went ?

Don't know about any remaining lottery winnings , but see my point ?

That is incorrect.

Alcohol is legal. But restricting zero consumption of alcohol or even barring entry in licensed premises is common for those on probation and parole.

If you are a NY Probationer or Parole, and you are ordered to do no gambling (and this is standard) then you are not to play NYS lotto (or any other gambling even if legal.) Being caught doing so will get you violated even if it is just having a losing or as yet undetermined ticket in your wallet. Claiming a large prize will get you violated, the prize likely seized.

To the original poster, I was referencing the extreme unlikelihood of winning in my original post. The lotto is stupid. Please see my sig line for my feelings on the subject.
