I am in Louisiana. the Company I am working for is in a suit. We have not gone to court yet. It is about patient . I was not in the room when the patient fell. But I am the supervisor to the technician that was in the room. In the suit, the person is suing, The company, the tecnician that was in the room and the insurance company. My name is not listed . Not even as a Jane Doe.
My boss is very angry over the suit and wants to ( counter Sue) I guess this is after the suit is over.
I saw a draft that he wrote to give his attorneys that he wants to sue on.... Conditions. The problem he listed my name as one of the persons that wants to contersue. I told my boss that I was not named in the suit not even as a Jane Doe. and I did not want to be involved in Suing this individual. She did not harm me by suing my company.
I asked the person that typed the draft if my boss had told him to remove my name as I asked him to but he did not follow my request. It will go to the attorney next. I want nothing to do with this but my boss is putting me in the middle. Would I even have the right to countersue if Im not listed in the original suit? I am under enough stress with the original suit. I really dont want to be invoved with this counter suiut.
