I currently live in(PA) low-income housing, governed by HUD. I was just up for my lease renewal in May. When prompted to sign the new lease, I was told that my rent was going up by over $200 per month!!! Of course they count my income from my employment and give me a break for my child care expenses. But, they are now counting my child support as income!! I have a court ordered support order in effect through Domestic Relations for $95 per week + $6 for arrears. In the entire time that I have had this court order (since Jan 97) I have never received regular weekly payments. I do occassionally receive payments (though never the amount they are supposed to be). Most of the time I receive a lump sum payment so that his butt stays out of jail. The manager of the property says that the child support must be counted as income, even with only the sporradic payments received. This is over $500 per month that they are counting as income that I can not count on receiving!!!!! What can I do? Is there some way that this income, even the little I do get, can be counted in some other way. And why is it that the Federal Government (tax wise) doesn't see it as income but in order to live somewhere it does? I need help fast. They want me to pay this extra rent, and I don't have it to pay because I don't get the support that is ordered. I have gone to Domestic Relations about the situation, but as usual they are so backed up, it will take months to get any money out of him. In the meantime, I'm going to get evicted for non-payment of the rent!!! HELP!!!

Contact the legal aid society or the HUD hotline. I believe you are correct -- ORDERED child support is not income & received CS is probably not income either.
