Ohio, Lucas County
My wife and I are seeking advice, I was out of work for eight months and my wife is currently unemployed.
In 2008 I was offered a promotion/raise and to move to another state by my employer or be unemployed in Ohio. We had a home we loved and family here. Against my better judgment my wife and I decided to give it a try, with unemployment the way it was and other financial difficulties we were having it seemed like a fresh start.
Our home was financed thru Beneficial, and they were not willing to work with us to sell or refinance the property. We left the keys and informed them we were leaving, packed up and moved away. At the end of 2010, I found myself back in Ohio; company was not living up to contractual agreements and paying me less than I could afford to live on in Illinois. They offered to relocate me back to Ohio but my pay lower than before I moved and after about 6 months release me.
I was jobless from Oct. 2010 to Feb. 2011, we were fortunate to have family on my wife�s side help us out. During the time we lived with them I started to receive bills for the old property; property tax, water, sewage, trash removal. Then I received a citation regarding the condition of the yard.
I called the County office and they said the property belongs to me and that I was responsible for the fines and bills. I explained to them we had left the home to the bank, the clerk informed me that the mortgage was released and the deed had no liens files against it.
I verified with the Lucas County Clerk of Courts and there is no pending actions filed against the property or myself. Two years have gone by without any action on the property and the clerk stated the home was ours free and clear.
We have since moved into the home trying to make ends meet and slowly re-establishing ourselves. There are $4400 dollars in back taxes the bank left unpaid. We were working with the Lucas County Fairhousing Authority to obtain assistance in catching them up. They informed us there is a possiblity the mortgage company can come take the property.
My question is can the bank come back after this time and lay claim to the property after releasing the deed, I have copies of the releases and a copy of a clear deed in my possession, can debt collectors come after the home?
I believe they sold the debt to a collection agency, along with my revolving charge account.
Loan background: Beneficial refinanced our home using a questionable loan practice; they used a line of credit $10,000.00 that I had thru them to finance the down payment for my refinancing the home through their mortgage department.
