lying on a child support guidelines sheet

My x husband is claiming on his child support guidelines worksheet,that he only made 38,000 in 2004. His w-2 says 49,000. The only reason I know this is true is because he used to work for my grandparents and the w-2 was laying on a desk and I saw it. How can I get his w-2 presented in court legally? Last time we went to court, they did not ask him for his w-2. Also, he owns 2 four wheelers and says they are only worth 500 dollars. My children told me he spent 4000 alone on one of them, how can I prove that? They are both unregistered.

Request the court order him to produce his last 3 tax returns and his social security earnings statements (everyone gets one right before their birthday every year). These are very common documents to request.

hmmm i always throw those SS statements away, are you supposed to save them?

but i agree ask the courts to order him to show his tax returns! did he present pay stubs?

You don't have to save them, but when they are available, they come in handy when you want an income history. It shows how much you've made every year since you started working. In court, it puts a stop to the "I only made that much last year because of a huge bonus and this year I'm only going to make half that" excuse.

those SS things are not always an accurate guideline of income. Especially if you are self employed. I don't think they should be counted on as gospel.

also want to point out that child support is not based on assets, its based on income, so his ownership of four wheelers is neither here nor there for purposes of setting a child support amount.

I was just pointing out that he is lying.

unless your kids are atv dealers, you cannot prove he is lying based on thier word. so it is pointless to bring it up.

Why not just file for a modification of the order based on his income of 49K?

Include an affidavit stating that you saw his W-2, and the figure was 49K and not the 38K he put on his worksheet. You could also likely file for Contempt of Court for perjury as most of those worksheets include a sworn statement that the information is true. Filing for contempt is a giant pain, however, and probably not worth it. It would also not be worth it to mention the four wheelers as it won't have any impact on the order.

You need to see his itemization for business expenses and unreimbursed expenses. I'm in sales, and my deductions for all the stuff I do and pay for that my company does not cover are significant each year. This includes auto, goodies and treats for customers, co-op advertising, etc. Might he have any such, or other expenses, that are created as a part of the business generation process?

they were with him when he bought them anyone with half of a brain would know he spent more than 500 on brand new ATV'S they are only 11 and 12 years old, id like to put a stop to my x letting the kids ride them since they often out run the game wardens with my x.

yes he could have spent 4000 on them (combined) but they could be worth only 500 now! how old are they? they depreciate just like cars!
