Op, unless you were hurt physically, the long and short of your damages would be the value of the bag of M&M's your purchased.

Return them to the point of purchase and ask for a refund.

If you WERE hurt PHYSICALLY, you will have to get an attorney, prove to a court that the injury was the sole responsibility of the Mars company and prove to a court as to why the amount of damage you request is appropriate.

Since you have not mentioned anything about damages, go get your new bag of candy.

Ok, tell you what. Sue them. Sue them for your actual damages. That is, what you are actually out of pocket due to their obvious negligence.
