I would like to sue in Small Claims Court the recovery of $395.00 plus any damages the court will award, for my annual Ob-Gyn-well Women office exam with a co-pay of $30.00. I made my annual well women appointment with an Ob-Gyn and specifically stated that I wanted my exam to be performed by an M.D., for they asked me if I wanted to see a P.A. and I said, I do not use my annual women wellnes exam that my insurance company provides me on a P.A.
When I arrived I was escorted into the exam and was questioned by an P.A.,normal procedure and then the M.D. takes over. The P.A. then decided she was going to give me my breast and pelvic exam, she proceeded and then said well the Dr. is busy with another patient, it will be an hour before he can see you do you want me to go ahead and give you your pap test. I am bare naked and the P.A. has already assumed the role of an M.D. and then proceeds to entrap me in authorizing her to complete the exam or wait an hour, I had to go to work, she proceeded. As of today I have still not received my pap results and the exam was in 01/05/01. The receipt has the signature of the P.A. by State of Colorado Health law the insurance provider has to pay the claim.
If the M.D. was not available that day after I had waited two weeks for an appointment, then I should have been informed immediately when I signed in at the front desk and I would have re-scheduled or seen another Ob-Gyn. I was deceived. I have choices in this world and they were not exercised only violated by this M.D.'s office. I find the M.D. who runs a practice as a specialist in Ob-Gyn and having a P.A. perform all his annuals and pocketing the full amount of my annual monies my insurance company provides me fraud. Also, if an M.D. wants a P.A. to perform all his annuals then I, the consumer should have a choice of a co-pay of $10.00 and a $50.00-$75.00 charge billed to my insurance company. What a scam and what are my rights to sue? McDonalds has to sell 100% pure beef and not 100% horse meat!
