Maine Clam Law on "possession."

I thought possession was nine tenths of the law? My son was summonsed to court for short clams (clams under two inches) two hours after he sold them. I have dug clams for 40 yrs. and have always believed that once I sell my clams they are no longer mine, but belong to the buyer that bought them. Is this legal, what they are trying to do? By they I mean the DMR clam wardens in the state of Maine.

I'm sorry, but this is just too rediculous to bother about. Look around this site. People are in real trouble, losing homes, people in prison, credit problems, being sued for everything, idiot women trying to terminate a father's rights to children, and you want us to be concerned about "clams"?

Okay. You believe that issues about clams are important. I don't. However, I'll make you a deal: I'll respond with cohesive and thoughtful suggestions for your clam situation if you can make a cohesive and logical argument that issues concerning clams are as important, or more important, than issues about "child support", "someone being unfairly imprisoned", or "someone losing their home in a bankruptcy" or any of the other issues on this site - - you pick one. Is that a deal?

We would all love to read your responses, without "smelling the roses" or the clams.

Apology accepted. Short note: I am very discriminatory of "issues" that I respond to on this site - as most everyone is. You'll notice that no one else has responded to your perceived "clam" problem. I was hoping you could justify your request so that I could spend hours doing research on "clam laws" - - but, you didn't. I guess we're all "crab" lovers.

***it wouldn't take hours to research the Maine clam laws. Probably it would take about 20 minutes. It has always been that whoever had clams in their possession owned the clams and was responsible for illegal clams. The wardens summonsed my son two hours after he had sold them. In my mind when a clam buyer buys the clams, they belong to him, and he should be accountable for any fines. Thanks for your concern.

If I go out and dig up clams i'm going to find out what is the legal size is so that way when fish and game comes by and checks everything is great!!
