Mayor vs City Police. Legal?
Is it legal for a Mayor to be an attorney defending a person being charged by the city police from the same city?
Story:
My wife was hit by a vehicle driven by a man that had ran away before the police arrived and later the next morning claimed that his home was broken into and his vehicle key stolen. The police pressed hit and run charges against this man based on an eye witness. After months of court continuations due to the eye witness not showing up the DA dismissed the case without trial.
My issue here is, and of course I'm the husband of the wife that was the victim in this crash, the defending attorney is a newly elected and acting mayor. If there was a trial the mayor could have had to cross examine the police officer that was pressing the charges.
