What is the name of your state (only U.S. law)? Texas.

Do to hurricane Ike I was paid for 48 hrs of work of which we did not actually work and were allowed to make up time for this pay. My make up time was calculated by anything more than 40 hrs worked. My question is on the week of Thanksgiving I actually worked 52 hrs. and received an 8 hr holiday pay. My employer tried to tell me that only 12 hrs was make up and not 20 hrs. I told her that my make time was 20 hrs because I would have gotten the 8 hr holiday pay anyway. If we went by her thinking she would have had to pay me for 40 hrs worked plus 8 hr holiday and then 12 hrs make up. Which would have made my pay check have 48 regular hours on it instead of 40 hrs. Which is correct?

Thanks

As far as the law is concerned, if you were paid for all the time you ACTUALLY WORKED you were paid correctly. Anything beyond that is a gift from your employer and no opinions offered here as to what the employer "should" have done are binding on the employer.
