What is the name of your state?
Just want to know how I can make someone stop telling lies about me and distroying my family. I don't want a legal battle or go to court. I just want him to never talk to me, never mention my name, and never tell lies about me again.

Without going to court, you can't. Ever hear of "free will"? There really is nothing to stop someone from saying anything, unless someone is under a gag order by the courts and in your case... I do not see that happening. Most gag orders are awarded to keep someone from speaking during or about a pending court case, as to not sway anything from one side too the other or if someone is under investigation.

But if someone is really harassing you. Then maybe a restraining order could help you from ever having this person contact you or your family.

I really wish, Heather, that I knew the answer to that.

I have a whole list of people I need to use the answer on.

A cease and desist letter tells him to knock it off or prepare to be sued.

There are lots of people out there who watch too much TV and think they know the law well enough to correctly determine whether or not they have given you any real cause of action. Such an individual may simply ignore the threat and even escalate their harassment.

There are others who don't understand the letter is merely THREATENING suit. They will lose some sleep until they get what they THINK is competent reassurance that they are "safe". Sometimes their little period of stress is enough to shut them up.

You could easily find a model letter and adapt it for your purposes, but it won’t pack the same punch as if it came from an attorney. If it’s worth the dinero to you, find the attorney who will write the letter for the least pesos. All you are really buying from him is his letterhead.

Indeed, there is no limit to the potential reactions. There is the laughing fit, cardiac arrest, immediate liquidation of assets, a visit to the local “Godfather”, a scathing return letter (with or without expensive letterhead), the phone call that begins with “Were you talking to ME? Were YOU talking TO ME???? and ends with the crushing comment, “I’m the rubber you’re the glue, blah blah”, CLICK, the list goes on...

Everytime I send one of those, I invariably get a "you can't do anything to me, and if you do, we'll move for sanctions."

And, every time, about 6 months later, they regret that response.
