Malicious Prosecution

The police came over to interview me because my girlfriend told them I pushed her and when she fell she cut herself on her right hand and injured her back. She said this happened on 8-23-00 at 5pm. She went to the police on 8-24-00 at around 8:30pm and made her report, they gave her at that time a temporary restraining order which expiries in five days from 8-24-00. The police officer comes over to interview me on 8-25-00, I told him that my girlfriend is a lying and that she in fact cut her hand on a coffee pot on the morning of the 24 at 7am. The police officer and I fished the broken coffee pot out of the trash. The Officer takes the coffee pot with him when he leaves. Before he leaves I show him where my girlfriend was kicking my sliding glass door on 8-23-00 from around 5:30pm on and off till 3:00am on the 24 of Aug. I explained to him that I had asked her to leave my home and gave her a thirty day notice because personal problems she has created. When I showed him the bedroom sliding glass door, I showed him her foot print on the right side pane about 4&1/2 feet up in the air. Also I showed him a perfect right hand print that showed no blood on it what so ever, it was down on the left side panel about two feet up. It looked like when she fell after kicking the glass panels, she pushed her hand on the glass to help herself back up.. I also showed him that she destroyed the sliding glass door from opening properly. I told him she was trying to go through it so she could say I threw her through it. He did not arrests me, but in fact he said he was going to take the coffee pot to his lab and check it for blood, which they found her blood on it months later before they had me arrested. The officer also said he will be back the next day to take pictures and a print of that right hand print. Now this evidence completely exonerates me from any false claim that my ex-girlfriend has placed on me. You must remember, she had claimed I hurt her back as well when she fell, if this was so, how did she managed to jump up in the air 4&1/2 feet to kick the glass panels all night long???. With the cop coming back and taking the pictures and prints I do not worry. However The police officer does not come back and do his job, he never shows up to take the pictures and print of my ex's right hand print. Six's month's go's. by and the officer call me and tell's me he has to arrests me. I want to know is this Malicious Prosecution or not. The DA had this info 6 months before the arrested me along with my ex-girlfriends retracted story, yes that's right she went to the police on 10-13-00 and told them the truth. She told them that I was locked in my room and I did not do any harm to her. That did not stop the Santa Clara DA in Calif from bulldozing me and costing me thousands of dollars, putting me throught hell, jailled fingerprinted and treated like a common criminal with no credibility, striped of all humanity then to be told tough luck by the DA when they knew I was inocent and they said you can't do anything about it. You tell me isn't there any one out there who still beleives in civil rights?????? Are we just going to be subjected to a courpt system who puts thousands of inocent people in jail??I was one of the lucky one who could afford my defence, I feel sorry for the ones who are in jail and could not afford to fight false claim.
