I guy ran a red light from the right turn lane and tried to go straght, his Suv was loaded with garden supplies (fertilizer, moss, and the like) and a latter from the front windshied to the back window. It had also be lightly raining earlier in the day.
Having no other alternative (barring causing injury or death to others) I impacted his car on his driver side mid-car. Totaling my car. This saved the young boy in the car next to me (no seat belt and window down holding the fast food in his lap,and if my car had not hit the SUV he would have head on the boys car). His father agreed to be a witness. The other driver admitted fault at scene and to his insurance company. Mine would not help me with out me paying the deductable. After hiring a lawyer he asked me to see if I had Paid Medical and Underinsured. They told me that these things did not exist, that I had been misinformed. Long Short I was paying for these in my contract. Is this bad faith representation?
I was refered to a clinic after going to the ER 3 days after the accident, I started having a lot of trouble walking and was in pain everywhere. The clinic doctor would not perform a thoracic MRI (the whole time I told them that I was in severe pain in the thoracic area), after a C-spne was found clean, stating that the insurance company would not pay for another MRI and also stating that the pain in the thoracic was transferance from the neck (even after the C-spine was found clean).So they performed Horizontal Segmental Traction on my neck!? This caused even more problems. My neck has not been the same since. I refused to go back to them after this. Another doctor a neurologist claimed I had too many symptoms and if they could find the one thing wrong with me they would fix it. So they sent me to a chiropractor. This was extremely painful. The chiropractor discharged me back the the neurologist because the chiropractor knew there was more wrong than what he was told by the neurologist. So they sent me to a muscle specialist. Finally a year after the accident and several doctors later the specialist ordered the Full MRI. From T-6(bottom)/T-9(top) it was found that I had two comletely decimated disc and a bulge to the left on another (T-9 top), and another bulge in L-4(bottom). Extinsive muscle/nerve damage in neck and right side of back and arm. Neck muscle damage was severe after the traction. As well as spinal curves from my body trying to compensate for the bulges and bad disks. The specalist also ordered the Trigger Point Injections, this provided a 3/4 day of pain releif.
I took the full brunt of the impact, right arm and right leg, while trying to keep control of my car from causing any other accidents and that is the only reason that I was hurt.
Do any of you feel that this may be bad faith representation on my insurace company, and malpractice on the clinic doctor and/or the neurologist? Or am I just crazy?
Any advice is appreciated. And I'm sorry this is so long but the whole thng has become very complicated.
