In New Jersey...

My wife has an epileptic condition from her youth, and is prone to seizures/spells. While she was pregnant, her neurologist (also pregnant), lowered my wife's seizure medication levels (July/August). My wife suffered a spell (kind of like blanking out, eyes open, absolutely no control over anything, nor any recolection of activity during a spell) while driving (December). My son, the (unborn) baby, and wife were physically fine, but the car insurance only pays so much, and it seems as though the doctor should have realized any risk in lowering her dosage.

If there is any information which I have left out, I shall post it. Your opinion would be appreciated, and thanks in advance.

Given the absence - Thank G-D -- of physical injury, small property damage claims to collect a deductible are rarely worth the time and effort in any case, particularly for any lawyer to get involved. And reducing dosages for a pregnant woman sounds inherently wise -- and if it was reasonably sound medical treatment all you are left with is a possible failure to notify her of the consequences. The doctor will likely say he did tell her, and maybe he did.

What is fairly certain is that word of what doctors will say is a bogus, small time lawsuit will spread throughout the medical community and ask yourself if you were a doctor, would you take her, or any member of her family, on as a patient after that?

But fell free to ask a local lawyer - the request is free. And if the doctor is a known reckless practioner, or there is something else wrong, there may be a case that is worthwhile.
