A man gave me a gift of $1000. He mailed the bank draft to me here in Tn.. He visited me in TN. He is now visiting with friends in Oklahoma. He is not a U.S. citizen. Now, he is suing me in Oklahoma for his $1000 back. There was no written agreement showing that it was a loan. There was a verbal agreement that it was a gift. I have never been to Oklahoma in my life. What do I need to do so that he doesnt get the $1000 back? He is suing me in small claims court in Oklahoma and I reside in TN.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Go to small claims, HE will have to prove it was a loan and not a gift.

You are not telling us how this man came to give you this money -- that might pose a problem if you aren't telling us. So, be prepared for that.

Also, you mioght think of countersuing (before the court date) for frivolous suit filed, abuse of process.
