If the replys are yes she can fire me because refuse this favor can someone please kindly explain why?

Thank you

The answer is yes and the explanation is that no laws prohibit this.

I think it's an incredibly cheap and ridiculous thing for your manager to do but it's legal.

Yes she can. New Hampshire is an at-will State. If you refuse and she does fire you file for unemployment.

Can a manager fire you because you refuse to do a favor? Yes.

Is what she is doing a "favor"? No.

If you refuse to allow her to ship things to your address to avoid sales tax or for any other reason you can refuse to be part of it because it may involve some amount of mail fraud. If she fires you for that you can file a wrongful termination suit because you are protected from performing illegal or potentially illegal activities.

Thanks so basically it sound like I have no choice, if I don't want to get fired, to have her items shipped to my house so she avoid sales tax.

So legally I have no choice but morally its wrong

You DO have a choice. In fact, you have only ONE choice and that is to refuse to allow her to ship things to your home. Having an item shipped to your home to avoid sales tax is federal mail fraud, an illegal act. You cannot be legally fired for refusing to perform an illegal act. If you were fired you can file a claim for wrongful termination. While it is not very likely that you'd be charged or investigated for such an incident, it is still an illegal act.

LONDONDERRY, although New Hampshire is an "at-will" state, it also subscribes to the "public policy exception" to at-will employment, which is what antrc170 is referencing.

I don't believe it is federal mail fraud, but it is in violation of the state's laws. I do think there is a conspiracy to violate the tax laws of the manager's state. I agree with antrc170, while "at will" means you can fire for any or no reason, it does not mean you can fire for a prohibited one. Firing someone because they won't commit a crime would be a prohibited one. Proving things up could be hard and it is never easy to make a discrimination claim. I'll let some of the more knowledgeable employment people tell the best course as this could get sticky for everyone.

Darn, I didn't mention that I'm employed in MA and live in NH. My manager live in MA..... so I don't know if this changes everything. Sorry

I would also consider the nature of the things being shipped to your home.

What if, for instance, your boss decided to have a kilo of upper Californian Sensimillia shipped to your home? Guess who gets arrested for the pot?

Tell your boss that her shipping is over.
