my boyfriend filed for a divorce in february after being seperated since the previous year in april. the ex will not sign divorce papers. at the time of his seperation, she choose to keep their van and he would take the car. he also assumed the credit cards and loans which were taken out during the time of the marraige. the ex has just informed him that she is going to take him to court for the difference in the marital debt. just to explain, she insisted on keeping the minivan which is not paid for while he took on everything else. she feels he owes her the difference in her van amount minus the debt he already took on.

he pays child support and alimony consistently if this makes a difference.

can she sue him for the difference in the marital debt??

Any help would be appreciated.

Yes.. would she win? No idea.. to many factors involved. Were papers filed last year? Or are the current papers the first?
