I have filed a non-contested divorce that will be final in 12 days. The property settlement has been signed. My spouse and my father's names are on the mortgage loan of the house I now live in, and occupied for 6 years prior to the marriage. The agreement gives me two years (12-2-2003) to either get the house re-financed in my name solely, give him the option to refinance in his name solely or sell at the end of the two years. He tells me that as long as I live in the house, with his name on mortgage, I can't date or have any male person in this house at anytime. Can he do that? Nothing of that nature was stated in agreement we both signed. If the divorce is final and we are legally divorced, can he dictate such things to me? I am responsbile for all payments, repairs ect... for the next two years, and as I stated before, my father is co-owner of this property. My name does appear on warranty deed. Can you advise? Thanks--I live in Tennessee

He's full of crap.

You mean to tell me that he believes he can go around boinking women, but you can't get boinked in your own home?

He's living in a dream world. As long as the agreement is silent on the issue, let him believe he's correct until the he signs the divorce papers. Then, once the papers are filed with the court, tell him to go get fu*ked.

Thanks for the reply--the papers have been signed and filed with the court. I have a ciurt date of April 17th for the divorce to be final. I just wanted to make sure that once the Judge's signature was on the dotted line, he could not go back and change anything.

I dont't want to lose my house, and with my name not being on the mortgage, I just didn't know what rights I had. My dad won't agree to sell the house, what if I could get him to sign a quitclaim thing?

I only have 11 more days and Im legally divorced. Thanks for your help, my Attorney is never there to ask questions to.
