What is the name of your state? What is the name of your state? FL
If the husband built a house two years prior to the marriage (wife lived in house with him 1 yr before actual marriage) and the property taxes were in default at the time of marriage. Took all cash wedding gifts to pay back property taxes and the next 3 years of marriage used Joint Income tax to pay property taxes, would that make the home now a marital asset?
Also several improvments were made to the home during the marriage which increased the value of the home. Wouldn't the wife have some right to the appreciation of the home?
If homestead was filed 3 years into the marriage, would that make them tenant of entireties?
Sorry for so many questions, just trying to help my sister sort all this out.
Thanks

Whether or not it is considered a marital asset in Florida is moot. Florida is an 'equitable distribution' state. What that means is that ALL assets brought into the marriage are considered in the mix during property distribution.

That is a question of fact for the court to consider.

Sure, if both names are on the deed. Otherwise, no.
