my wife and I have been together for 3 yrs. next year both of us are going to grad school and will need financial aid. if we stay married, our joint income will be taken into account which will disqualify us from receiving aid and will reduce our eligibility for FAFSA. considering also that we have been paying on average $2K in marriage penalty taxes every year (money we could have used for school) it seems there is no point in staying married (no kids, property, etc).

I would like to know how legal it would be to divorce for these reasons and whether there is anything else we should be considering here. Once we get out of school, can we remarry? Also, one of us is a green card holder (permanent residence obtained earlier this year). Can divorce have a negative effect in prolonging residence in 10 yrs?
