Hi I'm an american and my girlfriend which is French. She is going to be visiting me soon in about 3 months. We've been together for 2 years and are very serious and very happy. I was living in France with her for the past year and recently had to come back to US because I could not get citizenship in France. We've been apart for 2 months now and shes coming soon to visit me. We can't dare be apart just like any serious relationship, so I wanted to suprise her when she comes and ask her to marry me. I know about the K1 visa but it will take too long and we just don't have the time. So if she says yes will it be possible for me to apply for her to adjust status?? She has no idea I'm going to ask her, just hoping she will say yes and is willing to change her life in US and live with me.
I have more questions but I 'm very curious about this subject. thanks=)

Yeah of course everyone does. I know people have done it, as far as getting AOS through marriage...I need advice from an attorney or someone that has lived through this situation before and prevaled. :eek:

I lived through the K1 process, and guess what, it didn't kill me. My marriage didn't start by breaking the law, we did it the legal way (what is a few months of wait compared to a lifetime together in legal bliss) and now we have nothing to worry about from USCIS.
 
Intent

Technically, it can be done. However, since your GF is traveling to the US on a tourist visa, she is supposed to be here doing touristy things, not get married two days after setting foot into this country. I believe (correct me if I'm wrong ImmgAttyLana) you need to wait at least 30 days or up to 60 days (which is recommended) after her 1st day of arrival to get married. After the 60 days is up, get married and file your I-130/AOS/Travel Document/EAD together.

Going the K-1 route is the right way to proceed as AHA mentioned.

YOU should make an appointment to speak with an immigration attorney who has done a LOT of family based cases. Emphasis on family based.

It should be worth a hundred dollars or so for you to get a private education about what yu can and can't do. If I tell you, it might look like conspiracy.
But, if you are willing to put your future, your future wife's future and your living situation at stake, $100 bucks looks like a pretty good deal.

YOU say your GF doesn't know about this plan, but you need to be sure. The immigration attorney I read the most has this to say about that: Do you feel lucky?
