What is the name of your state (only U.S. law)? Nevada

My wife and I have been married for a little under 3 years. We've both held full time jobs for the length of our marriage. I make about $300 A MONTH more than she does right now.

We are getting a divorce (weeks away from filing papers), and she is choosing to quit her good paying job and moving out of state. She keeps threatening me that if I don't do everything she wants me to, she will sue me for alimony. I make 2700/month after taxes right now, and she makes 2400/month.

We have one child about to enter kindergarten.

Can anyone give me advice? Will the judge look at reasons she up and quit her good paying job? Will her salary nearly matching mine the last few years make a difference? Will it make a difference if I file the papers before she quits her job? Thank you.

Calm down. Alimony doesn't work that way, and judges have seen every trick in the book. If she has no income, the judge is likely to impute an income to her that is equivalent to what she is capable of making. If you can prove what she has been making, that's all the better.

Realistically, she is blowing smoke.

Alimony is highly unlikely for such a short term marraige.

Alimony is even more highly unlikely when the earnings history for a couple, during a short term marriage, is as close as yours is.

Alimony is even more again, highly unlikely if one person voluntarily quits their job (unless of course they get a better job and if they get a better job, then that makes it even MORE highly unlikely).

Alimony simply isn't a potential issue in your case.

With whom will the child be living? You should file to prevent any moveaway. Obviously, neither of you is the child's full time caregiver, if she stays with you, she would not be disrupted from the environment she knows. I agree that STBXs voluntary unemployment should not be a reason for you to have to pay SS with a roughly 36 MONTH marriage.
