If you are an alien and you enter the US legally i.e. on a visa waiver or visa, can you marry a US citizen and acquire residency without having to leave the US.
If so, does the citizen you are marrying have to meet any requirements; i.e. earn a certain salary, etc..:confused:

You have to enter the country legally in order to get a marrage licence in the US (a licence is required to have a legal marrage). Therefore, if you illegally enter the US, you can't get a marrage licence, and therefore can't have a legal marrage, and you end up where you started - no citizenship.

she writes she enetered the counrty legally
yes you can marry the citizen of the Usa, do it before your visa expires. you can avoid in this way going back to your country and applying for a fiance visa.
You need a licence to get married, in my case they didn't even check my passport when we went to the office to obtain the licence.
about the requirements ; we have just started dealing with all tha paper work but somebody told that a citizen needs to earn at least 14 ooo a year. I know for a fact that INS wants a tax report for the last 3 y.

Marriage question

If you entered legaly overstayed and became illegal can you get the marriage license?

What do they ask for exactly when you apply for it.

I have drivers license SSN etc have my last 10 years tax returns etc would they check for legal status?

To Linkspider - if you are here past the expiration of your visa, it is not likely that you would be able to obtain a marriage licence.

For Asiatica - your fiance will have to meet income guidelines, to show he/she can support you a certain percentage above the poverty line. He/she will have to complete an affidavit of support to show this, and also supply W-2's for the last three years, copies of recent pay stubs, and possibly a letter from his/her employer.
