What is the name of your state? Maryland.

In the state of Maryland individuals are allowed to sell up to three vehicles per year without having a dealer license. However, if you sell more than three vehicles a year in the State of Maryland you must have a dealer license. To get a dealer license you must have a storefront location for your business.

I want to sell cars online on ebay...more than likely most cars will be sold to individuals outside the state of Maryland, but the potential is there to sell cars to other individuals in my state via ebay. Since I don't have a storefront (and have no reason to have one) I am unable to qualify for a dealer license in Maryland.

I do not want to break any laws and really can't find any information to assist me in this area of the law.

So -- my question is, if I sell cars (more than three) on ebay without having a dealer license, am I breaking any laws?

You answered your own question.

Your next home work assignment is to contact your state's department that deals with the licensing of auto dealers and ask them the same question. If there is a way around the store front requirement, someone there will know.

Thanks...I appreciate your response.

I found out this evening that my partner (body shop owner) does, in fact, have a dealer license. So, it looks like I can run the business off his license but may have to get a sales license under his dealer license.

Maryland is not kind to any automobile services -- so, I may be back to get more information. Thanks again!:)
