What is the name of your state?I bought a 2005 Malibu Maxx late last December. In February at 1800 miles approximately my car seemed to have a tire blowout on the driver's side and hit an oncoming '88 Toyota in a local left turn. My insurance company investigated the accident and from no fault put me at fault. I paid about $1500 for the deductible and a 2 week car rental.
The Toyota barely had a scratch. It didn't need any repairs. The car is being driven daily by a neighbor. My entire frontend, tire, driver side door and various other parts had to be replaced. Total cost to the insurance company was $5000. The work was done by the selling dealer's body shop.
Last week the front end collapsed without any warning while I was making a left turn into a parking lot of a shopping center. There was no car to hit. It just collapsed and stopped. This was really scary. All work is being covered completely under the GM warranty. Three witnesses who saw the incident and who happened to run a car repair facility said some 'bolt' had not been put on in the factory or at the dealership.
I have 3 questions to any experts out there. Thanks in advance for your suggestions.
1) What can I negotiate with the general manager of the selling dealer? The dealership has been very courteous and prompt. They have acknowledged a need for fairness. What are my options?
2) Should I inform my insurance company about the similarity of the two incidents and have them re investigate the first incident? At this time my premium is up $450 a year for the next 5 years.
3) How do I find out if the 2005 Malibu Maxx has a generic front end problem or is my car about to become a lemon? That implies I'm supposed to look forward to and survive a third incident under Maryland law! Should I wait for the third and burn??
