Maxicare claim not paid

On March 1998,I had a MRI/surgery performed at in Los Angeles. I went through my Maxicare primary care physician and received all the necessary approvals. I paid my $25.00 co-payment and assumed the procedures were paid for.

On April 2000, I received a notice from a collection agency representing the doctors whom provided anesthesia for the surgery requesting payment of services provided. I moved shortly after the surgery was performed and did not receive any correspondence or was aware that the bill had not been paid. As far as I know the rest of the surgery was paid.

I talked to the collection agency and they say I have 5 days to pay or they are going to have me served with papers. Is there anything I can do? I don't have the money to pay the bill.

I talked to Maxicare Member Services, last Friday and they would not discuss anything over the phone. They told me I had to do everything by mail. I composed a letter, along with attachments of my approval notices and mailed it to the address the same day.

I talked to the collection agency today and that is not good enough. They are proceeding with their papers.

My response:

Then, there's nothing more we can do for you, except to say that you'll need an attorney once the Complaint is served on you. Obviously, bring all of your papers with you to your initial consultation.

As a side note, the Collection Agency had better not be "bluffing" with you, by threatening legal action. If they do not serve you within a reasonable time, which would be 30 days, then they have violated the Fair Debt Collections Practices Act.
