May I relocate?

My husband and I have decided to separate/divorce. We are not yet physically or legally separated, but intend to do so as soon as financially possible. My dilemma is that my husband brings his girlfriend to our home where my daughter and I still reside, he allows her to spend the night, etc. I have made it perfectly clear that this is not acceptable and is even illegal in the state of VA to have a lover cohabitate with a minor dependent child and that I will call the police to have his girlfriend removed from the property. My husband is verbally and psychologically abusive, occasionally physically abusive. Unfortunately, I do not have any family or close friends in our area to offer even moral support, much less temporary shelter. I do, however, have family in another state where my daughter and I would have love and moral support regularly. Am I allowed to move out-of-state with my daughter although my husband and I have not drawn up any legal papers yet? If not, what would be the legal repercussions should I decide to do so anyway?

You can move yourself and your child to wherever you want as long as there has been no petition for divorce or seperation filed with the courts. I would definitely get evidencce about the g/f staying there, any abuse reports filed with the PD, any evidencce you can gather regarding the bad environment he has subjected you and the daughter to prior to leaving though as if he should petition the court and try to get custody based on you leaving the state you can show good cause for doing so.

Make sure when you get to where you are going that you let your soon to be ex know so he cannot file parental kidnapping on you.
