I was hit, but insurance was not valid at the time of the accident. It is the other driver's fault and her adjuster has totaled my car.

Does her insurance company have an obligation to pay for the damage to the car?

Will they withold paying for damage to my car because I was in effect driving without insurance?

Some states have laws that limit recovery and thus penalize drivers who are uninsured in personal injury situations. I am not knowledgeable about your state's laws, but where the laws exist they do not generally apply to property damage claims.
