i live in an apartment complex in MD, i have lived there for a year and just signed a lease for another year. my problem is they advertise they have a whirlpool. signs out side the place when you drive by and it's in all their advertisements. yes, technically they have a whirlpool ... the only problem is it hasn't worked since i moved in. i found out about it being broke when i went to use it after i moved in. the managment is always making up excuses of why it doesn't work. the one i hear most frequently is how people do disgusting things in it and they blow up the motor. the newest excuse is the pool pump broke so they had to take the pump off the whirlpool and put it on the pool. they now have a sign on the whirlpool stating it is only open monday - friday 10am - 4pm due to vandalism. the note states once they have security camera's it will be open full time. first they ordered the cameras 5 months ago and the whirlpool is still never open during the stated times.when i asked to see the public health records on the pool i was told they were lost and they couldn't find them. i'm tired of complaining about this and hearing the lame excuses. yet they still advertise they have a whirlpool.
i have heard from a former tenant that the whirlpool hasn't worked for 2 years before i even moved in. i feel if they are offering this as an amenitie then it should work and be available. do i have any recourse against the apartment complex. i pay my rent every month either on-time or before it is due.
the maintenance issue i talked about in the title is my air conditioner broke on last saturday. i paged the maintenance man and he told me it wasn't an emergency because the weather was nice and he would be out monday. the office is open on saturday and sunday, shouldn't the maintenance man be available when the office is open. plus does he have the right to tell me it's not an emergency? it's friday (6 days later) and it's still not fixed. they came out to look at it tuesday and they couldn't do anything so they had to call a contractor to fix it. they had one contractor fixing it but since someones husband works for a hvac company they cancelled the contractor and the lady's husband is coming out. i just want my ac to work it's hot. it's not my fault they have 1 maintenance guy to fix all the problems in 200+ apartments that are 13 years old. everytime i ask if they are going to get a 2nd maintenance man they say they are advertising for the position. when i ask for a copy of the employment ad i'm told "oh no... we are advertising by word of mouth." i'm kind of at my last straw and i really don't know if there is anything i can do. i feel sorry for the maintenance guy, but then again, he's still working there.
