"Mechanic" never fixed car but kept money!

I was in a car accident in April of 2000. My mom's neighbor's friend, "Crusher", a supposed mechanic agreed to repair the car for the cost of parts and $1000. My mom paid him $1500 for parts without my knowledge and BEFORE he had done ANY work on the car. Over a 3 month period nothing was repaired so she demanded the car back and the money and he brought back the car with a broken windsheild and missing battery and terminals. She demanded he repay the money he never did. She sent several letters and made many phone calls but he refused to repay her.

My question is - is there a statute of limitations on this? My mom lives in Texas and I am going to pay her filing fees if she can actually sue him. Thanks!!
