What is the name of your state? I Live in Sterling, Illinois. I just finnished converting a mini bus into a full service soft serve ice cream truck for good friends (we thought) who promised me they would "take care of me" as soon as they got up and running. I installed all electrical from the generator to all equipment including lighting inside and out. Not to mention all the other odds & ends it takes to complete a soft serve truck for inspections from the county (Whiteside). As soon as I finished the work, my so called freinds told me they used me because I was dumb enought to trust them. I want to know if I have a case and how I fill out form 1402 and if it is the correct form to use. I also have people willing to fill out affidavits. Have I been frozen out by Cappizzi Ice Cream?

Illinois Mechanic Liens

I really know next to nothing about Illinois Mechanic Liens or Form 1402 but I hated to see that no one answered your question.
I believe (and I think you would be wise to check all of what I say with your local government, seeing as how I am probably wrong) that you ALREADY have a mechanics lien on the ice cream truck, since you have done the work and have not been paid. You must notify your "friends" in writing that you have a lien on the truck for the work done (and do it soon as I think there is a time frame you must work within) and then you file a 1402 - again, I believe you must work within a certain time limit in order to make the claim against your friends. And again, check with an Illinois official on this - they can probably walk you through the whole process.
As for slander, what they said to you was certainly insulting and I would definitely look elsewhere for friends, but you have no case against them for that. It is their opinion, perhaps, but opinions are covered under freedom of speech and therefore protected speech.

Illinois web site

If you want more information on Illinois Mechanics Liens, you can read the Illinois Mechanics Lien Act on Illinois' web site, www.ilga.gov. The site has information on what to include in your initial letter to your "friends". Make sure you have your receipts for parts purchased and work completed. The affadavitts will be helpful, as well.
Hope this helps. Good luck.
