we are used car dealership. one of our customers has defaulted on her payments. the car is at a mechanics shop. he will not release the car to us because of the money owed on it. he was suppose to be filing a mechanics lein on it. not sure he has. i was told that we had to file a civil suite on it which will add up to pounding fees. we don't want to pay anything, just get the car back on which we are the lein holder. where do we stand on this matter? this has never happened before. on top of the fees we will have to pay $147.00 just to file. the vehicle is valued at 3400.00. she still owes 2000.00.
