What is the name of your state?California...

A contractor working on my home ordered lumber and has not paid the bill and now the lumber yard has threatened me with small claims court and a mechanic's lien. I never signed anything with the lumber yard, Is he within his rights to do this and what is my recourse. I believe the contractor has run out of money and like a fool I had paid him upfront.

Yes they can put a lien on your property and if you ever want to sell the home you will have to pay this off in order to give clean title to a purchaser.

You can also sue the contractor in small claims ct.
