Medicaid Eligibility for stepchild

What is the name of your state (only U.S. law)? Utah

My stepchild has been covered by Medicaid by her father. I recently got married to her mother and would like to put the stepchild on my insurance if Medicaid can no longer cover her. She would not qualify for medicaid if she were my legal daughter and under my full legal custody but since she is joint between my wife and her biological father I am not sure what needs to be done.

Can she still receive medicaid under these circumstances? I am happy to put her under my insurance but the father wants to keep her with medicaid, which is fine with me. I just want to make sure it is legal.

Also, the stepchild will be claimed on our taxes as a dependant every other year. Does that mean she can't be on medicaid those years?

Medicaid will be secondary to any other insurance coverage. And it should pick up copays and other out of pocket costs after the other insurance pays (though you will have to confirm that with them of course). Eligibility doesn't have anything to do with who claims the child on taxes, if dad is the primary custodial parent then his household income would be used. If you do get the child on your insurance, you should send the information to the medicaid provider so they know to stop paying as primary.
