I'm not sure if I'm posting this in the right place or not but hopefully someone can help me.

In December 2006 my daughter was phsically abused by her mom's husband. He was sentanced on June 1st and is now in prison. Now this past Saturday, I get notice from my insurance company that they are not covering any of her hospital bills from December 27th - January 8th. The amount owed is over $30,000. So this morning I called victum rights and the DA's office, and they are telling me they can not re-open the case NOW to order restitution. How can this be right? The victum rights people send me information back in January which I filled out an returned to them they told me since I have insurnace there is no out of pocket costs so they couldn't do anything and if anything comes up and I end up owing to call them immeadiately, now they are basically saying I'm screwed.

How can this be right? How can someone just do something like this and then stick the victum's family with the bill? What can I do? I know if I just sue him I will never see the money. Is there any other options, is someone just not giving me correct information? Please help.

See that's what I am not sure of at the moment. I had my kids on the state health care program until the insurance at my job kicked in, in January. So I thought the state health care covered it. I have phone calls into the hospital now to find out exactly what is going on.

My health insurnace through my job kicked in January 16. They are the ones saying it's not covered due to a preexisting condition. Which I was aware of since this happend before I had their insurnace, but why would the hospital even bill them when the policy wasn't effective until after she was released from the hospital? They had all of the other health care information. So I'm hoping that there is just some sort of mix up with the paperwork but if not how can I possibly be held responsible for this bill?

This should be easy to fix. The hospital billed your employer's insurance comany because you provided them with the information. However, since your daughter was covered through the state at the time, get the bills from the hospital, and forward them to the claims department for the state insurance.
