What is the name of your state?NC

I am wondering if my husband is responsible for my medical debt? It was under his employers insurance but he did not agree.sign anything saying he was responsible.

Also can they garnish a joint bank account?

On a side note I have written the collection agency to not contact me by phone (May 21st to be exact) and they are still calling as of yesterday, is there anything that can be done about that?

North Carolina is NOT a community property state, so your husband's wages cannot be garnished for your debt. On the other hand, creditors can garnish a joint bank account only up to the extent of your interest in the account, but that can only happen if the creditor gets a judgement against you. Since they will need a lawyer, that usually takes a while.

As for the cease communication letter that you sent to the CRA, did you send it by certified mail with return receipt?

I didn't send it certified, but I was thinking of sending another letter and it will be.

So when you say the account can be garnished up to the amount that is the extent of my interest does that mean how much I contribute to the account or is it more like I own 50% of the account so they can take half?

Hold on. Your DH may not have signed anything accepting responsibility, but the insurance thru his employer is in HIS name, so there could be some possibility of exposure there.

IF they sue you, win a judgment and sieze your bank account, they will likely take whatever is in the account - and you and your DH will then have to object to the levy and prove whatever percentage in the account was HIS and not yours.
