I have a question about medical flex plans, termination, and rehiring.

Suppose you contribute 4K into a flex plan for the first of 2010 and use
all of it in January and are terminated in February. You are not required
to pay that 4k back to the employer. But what if you are rehired in June?

In June you are rehired but all benefits start as if you are a new, never
been there before employee, you have to wait 60 days for all benefits to start.

And can you sign up for the medical flex plan again in the middle of the year?What is the name of your state (only U.S. law)?

For benefit of others reading this I will give you the same answer I gave you on the other board. You need to read the Summary Plan Description of the specific plan, which the employer/administrator is required by law to give you on request.
