What is the name of your state (only U.S. law)? OHIO

Is it true, that if a person is on Medicare parts A & B and something goes array during a procedure
where later it is uncovered that the Doctor was under the influence of alcohol; that the Hospital and
Doctor cannot be sued, because the person on Government Insurance in lieu of Private Insurance coverage?

Medicare is an insurance plan, not an employer of the physician or the hospital. It is not the same as a physician employed by the federal government (military) or a hospital owned and operated by the federal government (VA hospital, military hospital).

Medicare will be glad to recoup its monies paid for treatment resulting from medical malpractice. They will have a lien on any award given to the plaintiff.
