This is long, so I will outline:

-Last year....Medical Emergency, found creditor website.
-Rates listed as typically 5%-9% on website.
-Called Contact number, confirmed rates with rep, but advised it could be "slightly higher" due to credit rating.
-In doctor office, Friday just prior to 5pm closing,life/death procedure ready to commence, office receptionist calls company, company faxes "generic application" to her, she has me sign (I am "out of it"). She faxes it back to company, they approve it, and the emergency procedure is done by dentist.

-I never saw anything but application sheet I signed, never got a copy of application, saw any terms, or got a copy of anything.

-statements start with monthly payment 18mo/$2000 loan.
-I pay for about 10 months, then notice balance is still really high....too high.......
-I call for info on loan since I never got terms, application, or anything but a monthly statement on the loan.
-Runaround by various companies of creditor....no body can produce any documents.
-In house collections starts 3-4 calls/day from bogus number on caller ID...won't give any info...bogus company names, and want money and me to confirm there is a loan. Will not provide any info on loan.
-I quit paying, demanded documents of loan via certified letters including cease/desist on phone calls.
-after 3 months, envelope arrives without dates. Copy of a generic application fax ,with my signature. Also two type written pages "loan terms" with details of loan at 19.9% that appeared as though they were typed just before they sent it out. This is the first time I had seen anything!
-I have continued written requests for documentation and explanations......no cooperation. Just statements demanding full balance due now.
-Just got letter last week from company stating "a copy of original application and terms is unavailable" because " it was applied for over the phone." Also advised me they were discontinuing any written contact on collection of debt. But I could call an 800 number for more info.....and included a statement that I was not allowed to record any conversations.

So, I know this is a bit choppy, but trying to conserve space explaining.....

I sent letter back advising I still have no info requested from them, and corrected some statements they made in their letter which implied I asked them to stop written communication......(which I actually specifically requested they use written communication only, not telephone).

Any comments? They have not used collection, even after this has continued 4 months now.

You got screwed. You can't CD the original creditor and the FDCPA doesn't apply to them -- pay the balance in full and take the lesson learned.

Thank you for the feedback, "debt...". I am familiar with the two points you made and agree that this is but another example of why I chose to exit corporate america 9 years ago.

The corporate goal in many cases now is to design a multi-faceted structure of smoke and mirror subsiderary divisions to process, justify and defend the business booked by a sales force encouraged to use unethical practices whenever the window of opportunity presents itself.

Unfortunately for the company; lack of company ethics creates an atmosphere where employees are more concerned about personal job security, than cooperation within departments. The more employees there are, and the less cooperation there is.....the greater the tendency for mistakes to be made........and most importantly....the greater the chance that the employee will follow "company example".... which is to distort, lie, coverup, or not reveal the mistake.

This presents an opportunity for people like myself to correct an injustice, that at face value (as you have suggested) appears to have only one option: Accept it as a "lesson learned."

I for one, do not accept defeat that easily. The biggest mistake in being a Bully, is assuming every victim you choose is a Sissy.

Sorry for the novel........I will let you know if you were right.

Thanks for the info...
