medical malpratice?

I have seen the same DR for 10-11 yrs. I have told him for the past 2yrs that I was having trouble hearing (have had several ear infections, a hole in my eardrum etc)..I finally went to an ear, nose, and throat specialist on my own and found out that I had a cyst behind my eardrum and had to have a mastiodectamy. What i need to know is, Is this a basis for medical malpratice?

You may have a possible negligence claim, which is different from a malpractice claim.

What state are you in? The statute of limitation varies from state to state. Yours would begin from the date you first went to the ENT doctor who found the "cyst".

Do you have any permanent damage from this docs failure to properly diagnose you? In order to file a malpractice or negligence claim, you must prove that he/she acted negligently, (below the prevailing standard) and as a result, you have sustained injury.

I am in Alabama. I saw the ENT in September of this year and had surgery the next week.
(September 24 I think was the day of my surgery) I am still having problems with my ear at this time, so the outcome is yet to be seen.
