As a reminder, there is no indication given by Anna that there is any support for a class action lawsuit. The class action discussion is just a detour Mark_A decided to take.
I clearly said multiple times that Anna needs to find out how many people were affected, and then only look into the possibility of a Class Action lawsuit if many people were affected. Otherwise, if only she was affected, it is unlikely that any individual lawsuit would be worth the cost of perusing it, and a lawyer would require money up front regardless of whether the case was won or lost.

Yes, you can report the unauthorized access to the U.S. Department of Health and Human Services and Duke University Health Care, and you may have state law claims in North Carolina, but HIPAA does not let you sue directly. Consulting a local attorney can clarify if a lawsuit is possible.

This thread is nearly a year old and unlikely to be useful to the person who posted the question. He or she has likely made their decision long ago and doesn't need further input. They may not even ever come back to see it. I do not wish to discourage you from participating. It can be easy to overlook the date of the thread. But by checking the dates and limiting responses to people with current problems you'll do the most good helping those who need help now and won't end up wasting time writing up posts that the OP likely will never see. Welcome aboard!
