My son has gone to a cardiologist for 7 years. We are having to switch doctors because of our insurance. I have called the cardiologist on two occassions to obtain copies of his medical records and they refuse to give them to me. I even offered to come there and sign a release form, which I thought was standard, but was turned down. They said that since they are a secondary doctor, that the records can only be released to a primary physician. Is this correct. I am very upset with this whole thing.

I am a medical professional and I don't believe this is correct. They may charge you for copies - depending on your state law - Florida for instance you can charge $1 a sheet or $25 total or something similar to that. But I was under the impression that legally a patient has a right to his or her medical records. I would contact the local medical association that this doc is a member of and file a formal complaint. The assoc. may also have a copy of your local laws regarding medical records. It would help to have a copy and send them to your dr. certified mail. I would also check with your state dept. of professional regulations or medical regulations and file a formal complaint. Contact the hospitals he is a staff member of (contact the medical staff office) and file a complaint with the medical chief. The legal dept. of the hospital may also be able to help, if your son was treated there at any time by this doctor. I would press forward. With enough pressure, they should comply.
